protected.

I help define the scope of protection and handle the application through to the office’s decision. You can commission a clearance search separately. I recommend it before filing to better assess the risks to your brand.

Why entrust your brand to me?

Experience in disputes.
Clear business decisions.

Karol Czubkowski — attorney-at-law

I personally handle every matter. I combine over 15 years of law firm and in-house experience with practical experience in trademark cases.

I understand trademark disputes

I have represented clients in trademark matters before EUIPO, the General Court of the European Union in Luxembourg, the Polish Patent Office, Poland’s regional administrative courts, Supreme Administrative Court and ordinary courts.

I apply this experience when assessing your brand: I consider potential conflicts and the scope of protection with possible disputes in mind.

You receive a clear recommendation

I explain the risks, recommend a course of action and tell you why. I consider your plans, costs and the practical value of protection.

I ask myself: what would I do if this were my business and my money?

You speak to the lawyer handling your matter

You work directly with me — from brand analysis to filing and further protection within the agreed scope.

I respect the confidentiality of the matters entrusted to me. That is why I do not publish case details or client information.

  • A trademark is a sign that distinguishes one business’s goods or services — usually a name or logo. The Polish Patent Office is the national authority responsible for registration. A registration protects the mark in Poland for the listed goods and services; it does not protect the underlying idea, product or every use of a similar word.
  • The Nice Classification groups goods and services into classes, but the wording of the specification primarily defines the actual scope. We tailor it to the brand’s present and realistically planned activity. A narrow list may leave gaps; an unjustifiably broad one raises costs and may make the registration vulnerable for non-use.
  • I prepare and file the application and handle the matter through to the office’s decision. Standard handling includes routine correspondence with the office, tracking deadlines, informing you about fees and forwarding the registration certificate if protection is granted. The filing fee excludes clearance searches and opposition proceedings. Filing does not guarantee registration.
  • For 6 months from the filing date we check new applications that may conflict with the agreed mark within the agreed scope. Registry monitoring is not continuous surveillance of the marketplace, internet, domains or every actual infringement. A detected risk leads to analysis and a recommendation; an opposition or other action requires a separate engagement.

Clearance search and opposition proceedings are excluded.
Filing does not guarantee registration.

  • EUIPO is the European Union Intellectual Property Office. An EU trade mark has unitary effect and may protect the listed goods and services across all EU Member States. It is not worldwide protection, and an obstacle or earlier right in part of the EU may affect the entire application.
  • Nice classes organise goods and services but do not replace a precise specification. We draft the list around what the brand offers and realistically plans to offer in the EU. The scope cannot later be expanded within the same application.
  • For six months from the filing date we monitor new similar applications within the agreed scope. The service covers one mark and data available in the monitored registers; it does not automatically cover the market, domains, social media or unfiled signs. Any opposition or negotiation is a separate service.

Standard handling includes routine correspondence with the office, tracking deadlines, informing you about fees and forwarding the registration certificate if protection is granted. What will you receive after the search?

You receive a document identifying similar marks found during the search that create a risk of conflict, together with a recommendation on the next steps.

The search covers up to 3 hours for Poland or up to 5 hours for the EU. If a more detailed search is needed, I propose it and explain the risks. You decide whether to investigate further or accept the risks and file without additional checks.

04 / Frequently asked questions

Brief and
to the point.

We explain the essentials before you instruct us. The final recommendation depends on your mark, goods, services and planned markets.

Is the search required?

Under this offer, the search is a separate, optional service. I recommend it before filing because it helps assess the risk of conflicts with earlier marks. You decide on the scope of work after discussing the risks. The search does not guarantee registration.

Does the price include official fees?

No. The net prices are the firm’s legal fees. Fees charged by the Polish Patent Office or EUIPO are payable separately and depend, among other things, on the territory and number of classes. Before instructing me, you receive a breakdown of the legal fee and expected official fees.

How does a search differ from filing?

A search assesses the risk of conflicts and results in a document with a recommendation. Filing covers preparing and submitting the application and standard handling through to the office’s decision. The filing fee excludes searches and opposition proceedings.

How does the free assessment differ from the paid search?

The free assessment is a preliminary assessment of whether your name or logo can be registered. It does not replace an analysis of conflicts with similar marks. The paid search addresses those conflicts and results in a document with a recommendation.

Does the filing fee cover the matter through to the office’s decision?

I prepare and file the application and handle the matter through to the office’s decision. Standard handling includes routine correspondence with the office, tracking deadlines, informing you about fees and forwarding the registration certificate if protection is granted. The filing fee excludes clearance searches and opposition proceedings. Filing does not guarantee registration.

What do I receive, and what if more than 3 hours for Poland or 5 hours for the EU are needed?

You receive a document identifying similar marks found during the search that create a risk of conflict, together with a recommendation on the next steps. The search covers up to 3 hours for Poland or up to 5 hours for the EU. If a more detailed search is needed, I propose it and explain the risks. You decide whether to investigate further or accept the risks and file without additional checks.

When will you reply and file the application?

I reply to enquiries within 24 hours on working days. I file the application within 7 days of receiving all the information needed for filing. This is the filing timeframe, not the time needed to obtain the office’s decision.

Is it better to register the name or the logo?

A word mark — the name itself — usually offers broader and more flexible protection. A logo may be appropriate when its particular graphic form matters. In some cases, protecting both makes sense.

Do I need protection in Poland or across the EU?

That depends on where you sell now and where you realistically plan to operate. A national mark protects in Poland; an EU mark may cover all EU Member States, but brings a broader risk assessment and higher official fees.

Why search for similar marks before filing?

A clearance search helps assess the risk of opposition, refusal or a dispute with an earlier rights holder. It cannot guarantee registration, but it supports a better-informed decision.

How long does trademark registration take?

It usually takes several months if the office raises no objections and no opposition is filed. The exact timing depends on the office and the course of the individual case.

What happens if someone files an opposition?

We assess the grounds and available options: a response, negotiations, limiting the specification or withdrawing the application. Further work and its cost are agreed separately.
